Oviedo considers freezing permits for sale of sparklers, fireworks

In Florida, according to state statute, it's legal for you to safely set off fireworks and use sparklers on July 4, New Year’s Eve and New Year’s Day.

What city officials in Oviedo said they find unclear: Florida law about how and who exactly can sell them.

But it's part of the city's job to help enforce the law.

"From everything I've read it doesn't seem like the state law is very clear," Keith Britton, an Oviedo Council Member, said in a meeting Monday.

Oviedo council member Natalie Teuchert said the sparks of confusion started flying when the city granted a vendor a permit to sell sparklers.

"When it came time to actually go inspect their tent when they were open for business. Our fire marshal found that they were selling fireworks, Teuchert said.

Teuchert said the vendor applied for a permit for the July 4 season.

But council members said in a meeting they want more direction and considered an ordinance to stop handing out any permits until Halloween.

Ultimately, Oviedo city council decided to keep issuing permits for now.

They voted to see what the attorney general's office has to say before banning anything.

"Because it's not clear, you know if they can use it, but they can't sell it and we're underneath the state we have to kind of know how to proceed," Teuchert said.

Teuchert said they hope to have some illuminating advice before at least New Year's Eve. WESH reached out to the vendor's attorney.

The company said in part, that they find Oviedo's proposed moratorium to be unconstitutional.
